Questions to Ask When Considering Title.

  1. Is one spouse more subject to large liability than another, e.g. is one a doctor, lawyer, truck driver, etc. - someone liable for a large negligence or malpractice suit?
  2. Is there a danger of creditors coming after either spouse?
  3. Is there someone else besides a spouse that either spouse wants to leave all or part of interest in the property to, e.g. children from a previous marriage?
  4. Is there a danger of bankruptcy?
  5. Which form of title has the best tax advantages in your state? Consider federal income, inheritance, estate, capital gains taxes.
